These Terms and Conditions govern the LeisureTime Dining Service and should be read in conjunction with the LeisureTime membership General Terms and Conditions.

WEBSITE USER AGREEMENT

This LeisureTime Dining website is owned and operated by Last Minute Network Ltd trading as lastminute.com (Registered Office: 39 Victoria Street, London, SW1H 0EE, No.3538456) on behalf of Affinion International Limited (Registered Office: Charter Court, 50 Windsor Road, Slough SL1 2EJ. No.1008797). This is the user agreement which governs your use of this website.

General Terms - please note that this section relates generally to your use of the website and to all restaurant table reservations and event packages.

    1. Please take time to read this user agreement. We will not allow you to make a table reservation from the website unless you have confirmed that you have read this agreement.
    2. This website operates to an agency model. This means that lastminute.com acts as a disclosed agent for third party restaurants. What this means is that the contract for the table reservation is between you and the restaurant. Where we act as agent this will mean that lastminute.com has no contractual liability to you in respect of the table reservation. However, lastminute.com may still be liable to you if it has been negligent, it has misrepresented important information or has been in breach of any other relevant law.
    3. All table reservations made on the website are not an offer by lastminute.com to reserve any table, but an invitation to you to make an offer to our restaurants. We are free to accept that offer on behalf of those restaurants or to reject it. We will send you an e-mail confirming the contract if you are reserving a table from the website.
    4. Because the contract for the table reservation is between you and the restaurant any queries or concerns relating to the reservation should be addressed to us.
    5. As your contract is not with lastminute.com but with a third party restaurant, the making of a table reservation by you will constitute consent to us to retain your payment card details in order to process your reservation. We will only pass them on to the restaurant in the event of you cancelling your reservation within 24 hours of the booked dining time or if a cancellation is not notified and you fail to attend the restaurant
    6. Please make sure that you have read and understood the offer and booking details sections on the website, it is your responsibility to make sure you have done so.
    7. You undertake to us that the details you give to us while using the website are correct in particular that the credit or debit card you are using is your own.
    8. Our website will not stop you from making booking types such as two restaurant bookings at the same place at the same time.
    9. We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating this site there may be times when obvious errors occur. For example, very occasionally, this may result in a price, offer or service or other detail displayed or presented on the website being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.
    10. We do not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.

Data Protection and Privacy Policy for the lastminute.com site

  1. Please find below our privacy policy for the website which shall be deemed to be incorporated into this user agreement. Please read the following policy to understand how we will treat your personal data after it has been collected by us through your use of this website. If this policy changes then we will let you know via our homepage but we assure you that we only use your data as specified here and for our legitimate business reasons.

  2. When do we collect data?
    We can collect data on you from a variety of different sources these include

    1. When you make a table reservation from the website.
    2. When you become a subscriber;
    3. Via implicit data capture measures such as studying which pages you read the most and the use of cookies.

  3. What do we do with your personal information?
  4. When you make a table reservation via the website or give us any personal data as indicated above, we may need to collect information about you to process the transaction, fulfil your order and provide you with the services you expect then and in the future. This information may include, but is not limited to, details such as your name, your address, your phone number and your payment card details.

  5. Unless we have your express consent we will only disclose personal data to third parties if this is required for the purpose of completing your transaction with us. This is of course subject to the proviso that we may disclose your data to certain permitted third parties.

  6. We retain and use your personal information to provide you with the best remote commerce (including electronic and mobile commerce) experience by providing you with a personalised service and to give you details of offers which we think will be of interest to you. We may also use the information to process any transactions you undertake with us and for internal administration and analysis.

  7. We do not sell, rent or trade your personal information to third parties for marketing purposes without your express consent.

  8. For any of the above purposes we may send your information internationally including to countries outside the EEA. Some of these jurisdictions offer differing levels of protection of personal information, not all of which may be as high as the UK.

  9. Cookies

    The website uses cookies. A cookie is a small text file of which there are three types:
    1. Session cookies: These are used to maintain something called session state. If you consider your journey through the site to be a conversation with us and this cookie just reminds the site where we were in that conversation (for instance if at some point in the conversation you asked us to add a restaurant product to your basket, next time you click on the basket it is still there). These are required for the site to function but are not used in any way to identify you personally.

    2. Permanent cookies: These store a few numbers on your hard drive. You can view them by looking in the cookies directory of your browser installation if you are interested. They last for a long time and each time you come to our site you send us a copy of them. We use them to identify you between visits. For instance if you were looking at restaurants in London last time you were on the site and we have a great restaurant deal we may use this cookie to recognise you and show you our great deal. They are not required for the site to work but may enhance your experience. We do not store any personal data in these cookies, just a unique number that identifies you to us.

    3. Third Party Cookies: You may have noticed that we carry advertising from third parties on our site. Occasionally they may send you a cookie. We have no control over these.

    Although you cannot block "session" cookies as they are required for our site to function correctly you can configure your internet browser so that it can reject both "permanent" and "third party" cookies. How you do this will depend upon the internet browser you use (for example, Internet Explorer 5, Netscape 4 or Opera etc) and it is therefore impractical for us to detail here how you can reject those cookies. Please refer to the relevant internet browser manufacturer's website where you should be able to receive all the information you need.

    In the UK and Ireland we operate and are registered in accordance with applicable data protection legislation.

    By disclosing your personal information to us using this website or over the telephone, you consent to the collection, storage and processing of your personal information by us in the manner set out in this Privacy Policy.   12. Site security
    Every booking you make on this site is protected by our Secure Server Technology, this provides many security features including:
    Authentication: This assures your browser that your data is being sent to the correct computer server and that the server is secure.
    Encryption: This encodes the data so that it cannot be read by anyone other than the secure server.
    Data Integrity: This checks the data being transferred to ensure that it has not been altered.
    Our secure server software uses a security protocol called SSL3 (Secure Sockets Layer) to ensure the privacy of the information provided to us and at no time are your debit/credit card details transmitted unencrypted over the Internet.
SPECIAL TERMS - Please note these terms only relate to the purchase of the specific products to which they relate. Please note if there is a conflict or ambiguity between these Special Terms and the General Terms the Special Terms shall prevail:

    Restaurants
    1. If you use the website to book a restaurant you will only have to pay the relevant restaurant after you have eaten unless it is clearly indicated in the product information that you are to pay either (a) the restaurant or (b) us for the meal in advance.
    2. We will not charge you a booking fee for your restaurant booking.

    Miscellaneous
    1. You accept financial responsibility for all booking transactions made under your name or account.
    2. In order to make a booking you must be booking for yourself and have the legal capacity to make the transaction.
    3. You must make sure that all the information you provide to us is true and accurate.
    4. You must not use the website for speculative, false or fraudulent bookings.
    5. The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you, except if you wish to make copies of the website for your own personal and non-commercial use.
