JADE DINING PROGRAMME TERMS AND CONDITIONS

BOOKINGS:

  1. The Jade Dining programme is operated and managed by Last Minute Network Ltd trading as lastminute.com (registered office: 39 Victoria Street, London, SW1H 0EE, No.3538456) on behalf of Affinion International Limited (Registered Office: Charter Court, 50 Windsor Road, Slough SL1 2EJ. No.1008797).
  2. The Jade Dining programme offers an exclusive range of discounted dining offers under the name of ‘Jade Dining.’ Jade is a trademark of Affinion International Limited.
  3. There is no limit to the number of times you may use the service, provided you qualify for the Jade Dining programme.
  4. The discount is available on bookings for your relatives, friends, associates or others, providing you are one of the dining party.
  5. All bookings must be made online via the Jade Dining website.
  6. By making a booking with the Jade Dining programme, you shall be deemed to have accepted these terms and conditions on behalf of all the individuals in your dining party.
  7. At participating restaurants, subject to compliance with these terms and conditions, you will receive a twenty-five percent (25%) discount off the entire dining bill for a party of one (1) to four (4) persons – known as “Jade 25% Discount”. Drinks and VAT are included, but gratuities and non-food or non-beverage purchases are excluded. Other alternative dining special offers may be made available to you which are not part of the Jade 25% Discount range.
  8. The Jade 25% Discount offers are only available through the Jade Dining programme and bookings must be made in advance of your intended visit to the restaurant. Bookings must not be made directly with the restaurant.
  9. The Jade 25% Discount is not valid in conjunction with any other promotional offer or discount such as senior citizen rates, already reduced lunchtime and early evening specials or any other such offer, takeaways or drinks only. It cannot be guaranteed that the discounts will be available in December when restaurants run their Christmas menu, Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve, New Year’s Day, other bank holidays or celebrations such as Valentine’s Day or Mother’s Day.
  10. All Jade dining discounts and other special offers are offered subject to their availability at the time of booking. Please be prepared to be flexible over your dining time to avoid disappointment, especially at weekends.
  11. The Jade 25% Discount applies for up to four (4) people per booking.
  12. Subject to availability, the Jade Dining programme shall accept your booking by issuing you with a booking reference number. Please ensure you have your booking reference number with you on arrival at the restaurant.
  13. You will be advised at the time of booking whether the restaurant you have booked is a Jade 25% Discount offer or an alternative type of offer.
  14. The restaurants featured in the Jade Dining programme are subject to change at any time.

    PAYMENT:
  15. You must provide credit or debit card details to secure your booking when making a restaurant reservation.
  16. You will only have to pay the relevant restaurant after you have eaten.
  17. The relevant discount will be deducted from your bill where appropriate.
  18. The Jade Dining programme will not charge you a booking fee for your restaurant booking.

    CANCELLATIONS AND AMENDMENTS:
  19. All requests for cancellations or amendments should be notified by telephone to the lastminute.com Helpdesk.
  20. A charge of £10 per person may be made for cancellations made less than twenty-four (24) hours before the booked dining time at the restaurant, or if cancellations are not notified and you fail to attend the restaurant (a ‘no show’).
  21. The decision whether to debit your card with a cancellation fee or ‘no show’ fee shall be entirely at the discretion of the individual restaurant. If the restaurant does debit your card, it will do so within five (5) working days from your booking time.
  22. In extreme circumstances such as flood or fire it may be necessary for the restaurant to cancel your booking in which case you will be notified directly by the restaurant.

    CUSTOMER SERVICE:
  23. The lastminute.com Helpdesk should be contacted for all booking related queries, complaints and claims. Telephone 0870 444 7772. Your call may be recorded for quality and training purposes.
  24. Any complaints regarding the restaurant must be brought to the attention of the restaurant management at the time of dining, and, if not resolved to your satisfaction, should be notified to the lastminute.com Helpdesk. You will need to quote your booking reference number.

    LIABILITY:
  25. Restaurants have not been inspected specifically from the point of view of Members with special mobility needs. The information given is that supplied by the proprietor.
  26. All information about restaurants is correct at the time of publication, and every effort has been made to ensure the accuracy of the information provided. Neither Affinion nor lastminute.com accepts responsibility for errors or omissions. Participating restaurants may be subject to change without notice and published restaurant prices may also be subject to change without notice.
  27. The Jade Dining programme accepts no responsibility if a participating establishment ceases to trade or undergoes a change of ownership.
  28. The Jade Dining programme shall not be liable for any failure or delay in performance of its obligations that results directly or indirectly from any cause or circumstance that is beyond its reasonable control. Without limiting the generality of the foregoing, the following shall be regarded as such circumstances: act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken by the restaurant; strikes, lockouts or boycotts, embargos, blockades.

    GENERAL:
  29. The Jade Dining programme reserves the right to change these terms and conditions from time to time without notice.
  30. Except as otherwise provided in these terms and conditions, your statutory rights are not affected.

WEBSITE USER AGREEMENT
This Jade Dining website is owned and operated by Last Minute Network Ltd trading as lastminute.com (registered office: 39 Victoria Street, London, SW1H 0EE, No.3538456) on behalf of Affinion International Limited (Registered Office: Charter Court, 50 Windsor Road, Slough SL1 2EJ. No.1008797). This is the user agreement which governs your use of this website.

GENERAL TERMS - please note that this section relates generally to your use of the website and to all restaurant table reservations and event packages.

  1. Please take time to read this user agreement. We will not allow you to make a table reservation from the website unless you have confirmed that you have read this agreement.
  2. This website operates to an agency model. This means that lastminute.com acts as a disclosed agent for third party restaurants. What this means is that the contract for the table reservation is between you and the restaurant. Where we act as agent this will mean that lastminute.com has no contractual liability to you in respect of the table reservation. However, lastminute.com may still be liable to you if it has been negligent, it has misrepresented important information or has been in breach of any other relevant law.
  3. All table reservations made on the website are not an offer by lastminute.com to reserve any table, but an invitation to you to make an offer to our restaurants. We are free to accept that offer on behalf of those restaurants or to reject it. We will send you an e-mail confirming the contract if you are reserving a table from the website.
  4. Because the contract for the table reservation is between you and the restaurant any queries or concerns relating to the reservation should be addressed to us.
  5. As your contract is not with lastminute.com but with a third party restaurant, the making of a table reservation by you will constitute consent to us to retain your payment card details in order to process your reservation. We will only pass them on to the restaurant in the event of you cancelling your reservation within 24 hours of the booked dining time or if a cancellation is not notified and you fail to attend the restaurant.
  6. Please make sure that you have read and understood the offer and booking details sections on the website, it is your responsibility to make sure you have done so.
  7. You undertake to us that the details you give to us while using the website are correct in particular that the credit or debit card you are using is your own.
  8. Our website will not stop you from making booking types such as two restaurant bookings at the same place at the same time.
  9. We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating this site there may be times when obvious errors occur. For example, very occasionally, this may result in a price, offer or service or other detail displayed or presented on the website being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.
  10. We do not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.

    We can collect data on you from a variety of different sources these include.

  3. What do we do with your personal information?
    When you make a table reservation via the website or give us any personal data as indicated above, we may need to collect information about you to process the transaction, fulfil your order and provide you with the services you expect then and in the future. This information may include, but is not limited to, details such as your name, your address, your phone number and your payment card details.
  4. Unless we have your express consent we will only disclose personal data to third parties if this is required for the purpose of completing your transaction with us. This is of course subject to the proviso that we may disclose your data to certain permitted third parties.

We retain and use your personal information to provide you with the best remote commerce (including electronic and mobile commerce) experience by providing you with a personalised service and to give you details of offers which we think will be of interest to you.     Data Integrity: This checks the data being transferred to ensure that it has not been altered.

    Our secure server software uses a security protocol called SSL3 (Secure Sockets Layer) to ensure the privacy of the information provided to us and at no time are your debit/credit card details transmitted unencrypted over the Internet.

SPECIAL TERMS - Please note these terms only relate to the purchase of the specific products to which they relate. Please note if there is a conflict or ambiguity between these Special Terms and the General Terms the Special Terms shall prevail:

Restaurants
  1. If you use the website to book a restaurant you will only have to pay the relevant restaurant after you have eaten unless it is clearly indicated in the product information that you are to pay either (a) the restaurant or (b) us for the meal in advance.
  2. We will not charge you a booking fee for your restaurant booking.

Miscellaneous

  1. You accept financial responsibility for all booking transactions made under your name or account.
  2. In order to make a booking you must be booking for yourself and have the legal capacity to make the transaction.
  3. You must make sure that all the information you provide to us is true and accurate.
  4. You must not use the website for speculative, false or fraudulent bookings.
  5. The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you, except if you wish to make copies of the website for your own personal and non-commercial use.
